Brian J. Capitelli

When facing federal prosecution or criminal charges, you need a lawyer who has the experience to know what battles to pick. You want someone who is fearless.

Brian Capitelli’s experience in federal and criminal proceedings means that he knows that choosing battles wisely can make all the difference in a case.

Now, as Partner at Capitelli & Wicker and the 2023-2024 President of the New Orleans Chapter of the Federal Bar Association, he uses this experience to improve the lives of his clients and the legal community as a whole.

Brian attended Boston College, where he majored in finance. Brian already had his sights set on studying and practicing law, and knew that studying such an exacting science like finance would lay a strong foundation. It is with that kind of foundation and skill set that he now approaches the legal complexities of white collar crime.

At the Paul M. Hebert Law Center at Louisiana State University, Brian distinguished himself as a member of the Law Review.

Brian began his career working with two prominent New Orleans law firms where he served clients in complex commercial and maritime litigation. Following this, he worked for several years as a Federal Prosecutor. During his tenure at the United States Attorney’s Office for the Eastern District of Louisiana, he successfully prosecuted a wide variety of cases including environmental violations, public corruption, bank fraud, and other federal crimes.

With his background in federal practices and strategies in white collar cases, Brian anticipates the government’s actions when he is defending a white-collar case. He knows what information federal prosecutors look for and the tactics they use when pursuing indictments.

At Capitelli & Wicker, Brian provides legal services to large corporations and business owners with tax, employment, or healthcare issues. He also represents individuals seeking defense in white-collar and criminal matters or facing administrative or licensure issues before State and Federal boards.

Brian’s clients are often facing difficult and terrifying charges. Their business, their reputation, their livelihood, their future–all is at stake.

Though always prepared to take a case to trial, Brian also has a strong reputation for negotiation.

Brian has found that for his clients, the best outcomes are often not the ones that get splashed on the front page news. Rather, the most favorable outcome can be Brian finding a quiet resolution to a case, where media-wise it is as if no one ever knew about the case in the first place.

The biggest victories are those where Brian can obtain a diversion from the prosecution or prevent the federal government from indicting a client. The client moves on with their life with their reputation intact.

Attorneys and clients alike trust Brian’s calm ability to develop strategy and look at a case from all angles. That’s why he gets called upon to handle regulatory issues and matters of conflict of interest in complex civil matters.
